The processing of payments on the www.ganonature.com site takes place via PayPal, the payment method most used on the Internet to make secure online purchases using credit cards, debit cards or bank accounts.
At no time during the purchase process, the Seller will be able to know the Customer’s credit or debit card number, which is transmitted directly to a page managed directly by PayPal, which manages payments on behalf of the Seller respecting the most high safety specifications.
The Consumer can also use his PayPal account to make the payment, if registered, and in case of cancellation, the amount will be refunded to his PayPal account.
The Seller will send to the Consumer the receipt (or invoice) in paper format, together with the specifications of the products purchased, via e-mail to the address indicated by the same when registering on the Site.
The Seller will take charge of the purchase order reserving the right not to proceed with the same in the event of unavailability, even temporary, of the products. In any case of unavailability of the product purchased after delivery of the order, the Seller undertakes to inform the Consumer about the circumstance at the e-mail address communicated by him and to provide as soon as possible the refund of the total amount – established by the price purchase, shipping costs and any other additional costs.
Alternatively, the consumer can instead opt for a voucher for products sold by Gano Nature of total value and quality equivalent to the original order, which can be spent within 6 (six) months from the date of issue.
Deliveries will be made in Italy and in the countries indicated in the list on the website, by express courier. Gano Nature reserves the right to use couriers and / or to use different delivery methods based on the type of transport requested by the Consumer. The different types and the relative rates will be indicated at the time of the order and automatically managed based on the weight, the quantity and the size of the products chosen by the Consumer.
Transport, if necessary, will be carried out using appropriate containers suitable for the transport of perishable and frozen goods in order to ensure that all products arrive in optimal conditions of freshness and conservation at the address indicated by the Consumer.
The Seller undertakes to do its best to deliver the ordered goods within 15 working days from the sending of the order confirmation to the Consumer and, in any case, except in the case of force majeure or accident, to perform the delivery in a maximum time 30 days from the conclusion of the contract.
Once the products have been shipped, the Seller will send a communication via e-mail to the Consumer, specifying the tracking number of the shipment through which it will be possible to follow the delivery status, when it is entered on the Courier’s Website. The courier delivers on weekdays, during normal office hours, excluding national holidays. Delivery is completed when the goods are made available to the recipient at the indicated delivery address.
If the goods sent cannot be delivered for any reason attributable to the recipient, the Courier will leave a postcard to certify the delivery attempt containing the notice that the goods will be in storage. In the event of obvious signs of tampering or alteration, the Consumer must refuse delivery or accept it with reserve and promptly report the circumstance that describes the detected defect and providing all the information necessary for the Seller to keep any claims against the manufacturer or courier, to verify the existence of the alleged defect, after each re-shipment of the goods.
To this end, it is essential to preserve the items in the conditions described so that they can be returned as received.
The Seller will carry out the verification of the case in relation to the defect requested as soon as possible and in any case within 30 (thirty) days of making the product available and will inform the Consumer of the outcome of the verification and, if the conditions are met , will reimburse the Consumer for the shipping costs incurred for returning the product and for sending, without additional charges, a new product or the product actually ordered as soon as possible, provided that it is available.
The Seller reserves the right to charge the Consumer with any costs incurred for the verification of the product if it is intact and / or free of flaws and defects reported.
Delivery depends on the product and stock availability.
At the time of shipment you will receive an e-mail with the shipment number and the link from which you can track the shipment of your order.
Pursuant to and for the purposes of Legislative Decree n. 206/2005 (Consumer Code) and subsequent amendments, the Seller provides the Consumer with a legal guarantee on the product for any lack of conformity with the sales contract that takes place within 24 (twenty-four) months from delivery of the product to the Consumer.
Any defects of any kind caused by accidental or consumer liability or use of the product that does not comply with the intended use and / or provided in the technical documentation attached to the product are excluded from the scope of the legal guarantee. where it exists, or in the instructions for use relating to it. Products modified or in any way altered by the consumer are also excluded from the legal guarantee.
The lack of conformity must be reported to the Seller, under penalty of forfeiture of the guarantee, within 14 (fourteen) days from the date on which it was discovered. Any notification of a product conformity defect must be presented together with proof of purchase of the product by the Consumer, which describes the defect found and provides all the information useful to the Seller to preserve any recoveries, as well as to agree on how to deliver the products of the product to allow the necessary checks.
Gano Nature will carry out the verification of the case in relation to the lack of conformity reported within 30 days (thirty) from the availability of the product. The Seller will inform the Consumer of the outcome of the verification and in case of ascertained non-conformity of the product it will replace it as soon as possible and in any case, except in exceptional cases or force majeure, within 45 (forty five) days from the day on which the defective product was received. If replacement is not possible due to the unavailability of the product, Gano Nature will provide the consumer with a good purchase of products sold by Gano Nature of a corresponding value, available within 6 (six) months from the date of issue. Gano Nature reserves the right to charge the Consumer with any costs incurred to verify the product if it is free of complaints.
The Seller is not liable in the event of damage of any kind resulting from improper use of the product and / or not in accordance with the instructions provided by the manufacturer and in the event of damage resulting from unforeseeable circumstances or causes of force majeure.
With regards to damage caused by a defective product, the provisions of the Consumer Code and subsequent amendments apply. The seller, as a distributor of the products through the website, is released from any liability, excluding and / or excluding, indicating the name of the relevant product manufacturer.
In no case will the Seller be held responsible for failure to fulfill any of the obligations arising from these Conditions in the event that the breach is caused by unforeseeable circumstances and / or force majeure, including accidents, explosions, strikes and / or lockouts, natural disasters, terrorist acts, network malfunctions and / or blackouts, and other similar events that prevent, in whole or in part, from executing the contract within the agreed time. The Seller will not be liable to any party or third party for damages, losses and costs incurred due to failure to execute the contract for the reasons mentioned above, since the Consumer is only entitled to reimbursement of the total amount paid, composed from purchase price, shipping costs and any other additional costs.
Obligations of the Consumer
The Consumer undertakes, once the purchase procedure has been completed, to print and keep these Conditions, already viewed and previously accepted as a necessary step for the purchase. It is strictly forbidden for minors to place orders of any kind. The identifier with which the registered Consumer can access the Site cannot be transferred or used by third parties. The consumer guarantees that the personal information provided during the registration process on the Site is complete and truthful. It is strictly forbidden for the consumer to enter false and / or invented and / or fictitious data in the registration procedure necessary to activate the process for the execution of this contract and the related additional communications. The Consumer has the right to withdraw from the purchase contract for any reason, without having to provide explanations and without any penalty.
The risks and transport costs related to the return of the products to the Seller will be borne by the Consumer.
To exercise this right, the Consumer must send, within 14 (fourteen) working days from the date of receipt of the goods, the notice of withdrawal. To this end, the Consumer can use any explicit statement of his decision to withdraw from the contract. In the notice of withdrawal the Consumer must indicate the order number and the date of the order, the invoice number if it was from the same request at the time of order completion, his own bank details (IBAN code).
The Consumer must return the goods according to the return methods. An essential condition for exercising the right of withdrawal is the substantial integrity of the products to be returned that must be received unopened in order not to fall in the event that this possibility of withdrawal is not possible.
If the verification of the returned products has a positive outcome and the right of withdrawal has been validly exercised in the terms and according to the procedures, the Seller will reimburse the Consumer, as soon as possible and in any case within 14 (fourteen) days from the date on which he came aware of the exercise of the right of withdrawal by the Consumer, the full amount paid for the purchase of products, excluding the direct cost of returning the goods to the Seller, which will remain the responsibility of the Consumer. In accordance with the art. 56, paragraph 3, of the Consumer Code as amended by art. 1 of Legislative Decree 21/2014, ULabl has the right to withhold the reimbursement until it has received the goods or until the Consumer has demonstrated that he has returned the goods, depending on which situation occurs first.
According to the art. 59, paragraph 1, lett. d) and e) of the Consumer Code as amended by art. 1 of Legislative Decree 21/2014, the right of withdrawal is excluded in the event that the sale relates to:
a) products that are likely to deteriorate or expire rapidly;
b) sealed products that do not lend themselves to being returned for hygienic reasons or related to health protection and have been opened after delivery.
Return and refund
If, following a complaint by the Consumer, the Seller requests the return of the goods to carry out the necessary checks, he will inform the Consumer, electronically, of the address of the warehouse at which the Consumer must send the goods without undue delay and in each case within 14 (fourteen) days of the communication. The goods must be returned or otherwise sent to the Seller integrates (without any sign of wear, abrasion, scratches, scratches, deformations, etc.), complete with all its elements and accessories, accompanied by instructions / notes / manuals attached, from the packaging and original packaging and warranty certificate, if present. To this end, therefore, it is advisable to cover the original packaging of the products with other protective packaging that preserves their integrity and protects them during transport, including by writing or labels. In the event of the return of the goods due to the exercise of the right of withdrawal by the Consumer, the term of 14 (fourteen) days starts from the date on which the Consumer received the goods purchased. For the purposes of prompt return, the deadline is considered to be met if the Consumer sends back the goods before the expiry of the period of 14 (fourteen) days.
In any case where reimbursement is requested, the amount will be communicated in advance to the Consumer electronically and subsequently credited to the payment solution used by the Consumer for the purchase. Any delay in crediting may depend on the bank or payment solution used. In this case, the value date of the amount credited will be the same as the debit.
Intellectual property rights
The Consumer declares to be informed that all the contents of the Site are protected by copyright and other provisions in force concerning intellectual property: all rights are the exclusive property of the Seller. The contents of the Site may not be reproduced, in whole or in part, transferred by electronic or conventional means, modified or used for any purpose without the prior written consent of the Seller.

For any dispute between the parties regarding this contract, the Court will have jurisdiction in the district where the Consumer has his domicile or residence, if located within the territory of the State.
